The Service is owned and operated by Forging Destiny Studios, LLC ("Company", "we", "us", or "our").

Free Tier (MIT License) Components marked as "Free" are licensed under the MIT License. You may use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of these components without restriction.

Pro/Team/Enterprise Licenses Paid components are licensed under a commercial license. Upon purchase, you receive a non-exclusive, non-transferable license to: - Use the components in unlimited personal or commercial projects - Modify the components for your own use - Include the components in end products for clients

You may NOT: - Redistribute, resell, or sublicense the source code - Share your license key with others outside your licensed seats - Create derivative products that compete with KiteUI - Remove or alter any proprietary notices or labels

When you purchase a license, you will receive a unique license key. You are responsible for: - Keeping your license key confidential - All activity that occurs under your license - Notifying us immediately of any unauthorized use

License keys are tied to the email address used at purchase. Team licenses allow multiple seats as specified at purchase. We reserve the right to revoke licenses that violate these Terms.

Payments All payments are processed securely through Stripe. Prices are listed in USD and may be subject to applicable taxes.

Refunds We offer a 14-day money-back guarantee for Pro and Team licenses. If you're not satisfied, contact us within 14 days of purchase for a full refund. Enterprise licenses and custom development are non-refundable.

Subscription Renewals Enterprise subscriptions renew annually unless cancelled at least 30 days before the renewal date.

You agree NOT to use the Service to: - Violate any applicable laws or regulations - Infringe on intellectual property rights of others - Distribute malware or harmful code - Attempt to gain unauthorized access to our systems - Reverse engineer or decompile our software - Use the Service for any illegal or unauthorized purpose - Share license keys or circumvent license validation - Create competing component libraries using our code

Our IP KiteUI, including all code, documentation, designs, and trademarks, is owned by Forging Destiny Studios, LLC. The purchase of a license grants you usage rights but does not transfer ownership.

Your IP You retain all rights to applications and products you build using KiteUI components. We claim no ownership over your end products.

Feedback Any feedback, suggestions, or ideas you provide may be used by us without obligation to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT: - The Service will be uninterrupted or error-free - Defects will be corrected - The Service is free of viruses or harmful components

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGING DESTINY STUDIOS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: - Loss of profits, data, or goodwill - Service interruption or computer damage - Cost of substitute services

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Forging Destiny Studios, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: - Your use of the Service - Your violation of these Terms - Your violation of any third-party rights - Applications or products you build using KiteUI

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe: - Violates these Terms - Is harmful to other users or third parties - Is fraudulent or illegal

Upon termination, your license to use paid components is revoked. Free components under MIT license remain available for your use.

We reserve the right to modify these Terms at any time. Material changes will be communicated via: - Email to the address associated with your license - Prominent notice on our website

Continued use of the Service after changes constitutes acceptance of the modified Terms. If you disagree with changes, you must stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
